This Privacy Policy is intended to present a clear understanding of how we will treat your information when you access or use EverEx Rehab’s Service or communicate with us outside of the Service. Your use of EverEx Rehab’s Services is subject to our Terms of Use, which incorporates this Privacy Policy. This Privacy Policy must be read in conjunction with our Cookie Notice, and supplemental notices that may apply to you if you are a resident of California or the European Union/European Economic Area. All the documents combined constitute the entirety of EverEx Rehab’s privacy policy and will apply to our usage of your data, so please make sure you read and understand them as well.
This Privacy Policy describes how we collect, use, protect and share information we obtain when you access and use our Service, create a profile, submit information and updates about your condition, participate in promotions, or submit questions or feedback. In addition, this Privacy Policy applies to information that we obtain when you communicate or interact with us outside of the Services, including by e-mail, telephone and otherwise. This privacy policy also governs the collection and use of information when you use any of our Apps, as a part of our Service, although we may provide additional notice and choice options within the App itself. By accessing or using our platform or communicating with us outside of the platform, you are accepting and consenting to the practices described in this Privacy Policy, which may be updated and amended from time to time.
For purposes of this Privacy Policy, the terms below are defined as follows:
- “EverEx Rehab”, “we”, or “us” refer to EverEx, Inc. and our officers, directors, employees, contractors, and agents. To the extent applicable, they also refer to our affiliates, service providers and licensors, and their respective officers, directors, employees, contractors, and agents.
- ''You'', “your” and/or ''user'' refer to any individuals and/or entities visiting and/or otherwise accessing the EverEx Rehab Service for any reason.
- "Service" refers to any and all websites, Apps and content made available to you by EverEx Rehab, including any related services and promotions, and any software and technology used to provide any of the foregoing.
- "App" refers to any downloadable application (including a mobile application) owned or operated by EverEx Rehab. The term "App" encompasses the entirety of features, functionality, tools, and content accessible on or through each respective application.
- "Content" refers to any information, videos, text, photos, and other content provided or made available by EverEx Rehab on or through the Service.
- “User profile” refers to a profile posted by a user on the EverEx Rehab Service.
- “Personal information” includes, but is not limited to, any information that identifies or describes an individual, including his or her name, professional licensing information, social security number, physical description, age, gender, marital status, health status, financial status, home address, home telephone number, education, financial matters, and medical or employment history. Personal information may also include statements made by, or attributed to a user.
1. Personal information we collect

Information you provide
By voluntarily creating a user profile on the EverEx Rehab website, you agree to the EverEx Rehab Terms of Use, and consent to EverEx Rehab’s collection of Personal Information. To establish Your user profile, EverEx Rehab collects your name and email address, and in some cases your date of birth, height, weight, symptom scores, and ranges of motion.
You may give us information about you by filling in forms on our App and by corresponding with us by email, phone, mail or otherwise. This includes information you provide when you use the “Get in Touch” section of our App, discuss with us the provision of and/or receive services from EverEx Rehab, interact with us via our social media accounts (e.g., Linkedin) and when you report a problem with our Service.
You may give us additional information when You continue the use of the site and agree to our Terms of Use in order to use our Services and access our Content. When you complete rehabilitation exercises on the EverEx Rehab App, EverEx Rehab may collect data relating to the assignment of and/or completion of courses and/or exercises.
The types of personal information we collect includes, but is not limited to, the following:
- Identifying information (e.g., name, address, date of birth)
- Contact information (e.g., phone number, email address)
- Health information and medical records
- Payment and billing information
Automatically Collected Information
As you use EverEx Rehab, certain information may also be passively collected and stored on our or our service providers’ server logs, including your Internet protocol address, browser type, and operating system. Please read our Cookie Notice for more information.
Information we receive from other sources
On occasion, we may combine or compare data we have collected from you with information collected from other third-party sources and add it to the information you have provided.
Third parties that are unaffiliated with us may also collect information about you, including tracking your browsing history, when you use our Service. We do not have control over these third-party collection practices and advise you to adjust the settings of your browsers or install plug-ins and add-ins if you wish to minimize these third-party collections.
2. How we use personal information
We recognize and deeply value the trust you placed in us in allowing us to collect information about you. EverEx Rehab may use any of the information we collect to:
- help provide treatment, diagnosis, and coordination of care;
- carry out claims processing and billing;
- send you information that enables you to use our Service;
- manage your access to our Service;
- protect the integrity and maintain the security of our Services, including secured areas of the App or Website;
- contact you directly about activity on your account;
- carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including billing and collection;
- allow us to operate our Service, including administration, internal operations, troubleshooting, payment processing, data analysis, testing, research, statistical and survey purposes;
- personalize your experience, so we are better able to respond to your individual needs;
- improve our website through your feedback;
- effectively respond to customer service requests and support needs and improve customer service;
- process transactions;
- conduct research and compiling aggregate data for internal and external business purposes;
- comply with laws and regulations;
- fulfil any other purpose disclosed to you at the time we collect your information; and
- for any other purpose for which you may provide consent.
Much of the information collected by EverEx Rehab is necessary for proper functioning of the EverEx Rehab App and use of the EverEx Rehab Service. For example, you may not be able to create a user account or reset your password without provision of a valid email address.
Additional Information Use
We may use your email for transactional purposes, as well as for promotional purposes. Transactional purposes include confirmation and notification of changes to your account. Promotional purposes include sending you newsletters about new features, special offers, promotional announcements, consumer surveys, and other items concerning our service. During registration at the EverEx Rehab App, you may be signed up to receive promotional email newsletters from EverEx Rehab, unless disallowed by your jurisdiction of residence. Email messages may contain code that enables our database to track your usage of the emails to determine whether the email was opened and what links, if any, were clicked. Should you prefer not to receive promotional emails from us, please edit the preferences in your account menu or click unsubscribe at the bottom of any promotional emails.

EverEx Rehab will not use your personal information to
- sell, trade, or rent any users information at any time
4. How we share and disclose personal information
We may share your information with trusted third parties who assist us in operating our website, conducting our business, or serving you, as long as those parties agree to keep this information confidential to the extent outlined under this Privacy Policy and consistent with applicable laws and regulations. Unless we tell you differently, they do not have any right to use your personal information beyond what is necessary to assist us.
Third parties include the following:
- Patient management and rehabilitation exercise monitoring: Healthcare providers
- Infrastructure: Amazon Web Services (AWS)
- Analytics: Google Analytics
We may disclose your personal information at the request of law enforcement or government agencies or in response to subpoenas, court orders, or other legal process to establish, protect, or exercise our legal or other rights or to defend against a legal claim or as otherwise required or allowed by law. We may disclose your personal information to protect the rights, property, or safety of a user or any other person. We may disclose your personal information to investigate or prevent a violation by you of any contractual or other relationship with us or your illegal or harmful activity.
Over time, EverEx Rehab may grow and reorganize. We may share your personal information with affiliates such as a parent company, subsidiaries, joint venture partners or other companies, in which case we will require those companies to agree to use your personal information in a way that is consistent with this Privacy Policy.
Non-personally identifiable information may be provided to other parties for marketing, advertising, or other uses.
You have the right at any time to prevent us from contacting you for marketing purposes. You can opt-out of promotional communications by following the unsubscribe instructions provided in each promotional email that we send to you. We may continue to send you administrative emails; for example, periodic updates to our Privacy Policy, even if you indicate that you no longer wish to receive promotional email from us.

EverEx RehabEx will not sell any collect Personal Information to third parties.
5. How we protect your personal information
Data Breach Protocol
the event of a data breach, EverEx Rehab will adhere to the applicable Federal and/or State data breach regulations of the impacted user(s). For purposes of this policy, a breach is any unauthorized acquisition of computerized data that compromises the security, confidentiality, or integrity of personal information that we maintain.
EverEx Rehab takes various security measures—physical, electronic, and procedural—to help defend against the unauthorized access and disclosure of your information. In addition to the restrictions discussed in this Privacy Policy, our employees are required to comply with information security safeguards, and our systems are protected by technological measures to help prevent unauthorized individuals from gaining access. EverEx Rehab employees are trained to observe and comply with applicable Federal and State privacy laws in the handling, processing, and storage of your information.
Despite these precautions, no system can be completely secure and there remains a risk that unauthorized access or use, hardware or software failure, human error, or other factors may compromise the security of your information.
Upon discovery or notification of any unauthorized access disclosure, EverEx Rehab will take immediate measures to safeguard and prevent further dissemination of any personal information. When reasonably able to do so, EverEx Rehab will notify the impacted parties via contact information on record, with information including but not limited:
- EverEx Rehab’s contact information.
- A general description of the breach incident.
- An explanation, to the best of our knowledge, of what happened.
- A listing of the types of personal information that is believed to be compromised.
- If known, the date and time of the breach, or a best estimate.
- Whether the notification was delayed as a result of law enforcement.
- What steps the EverEx Rehab has taken to mitigate the situation, prevent it from happening again, and advice to the impacted individuals on how they can best protect themselves.
- Notifications will be sent via email to all impacted users. Written notice may be sent in addition to email. Depending on where the impacted user lives, they may have a legal right to receive notice of a security breach in writing.
EverEx Rehab is not responsible for circumvention of any privacy settings or security measures of the EverEx Rehab Service. You understand and acknowledge that, even after removal, copies of personal information on user profiles may remain viewable in cached and archived pages or if other users have copied or stored your personal information.
The EverEx Rehab App might be linked to other apps and websites, including but not limited to Facebook, LinkedIn, or Twitter, in order to better interact with its users and the public. Please be aware that EverEx Rehab is not responsible for the privacy policies of those other services. If users provide information directly to services other than EverEx Rehab, different rules may apply for the use of personal information.
6. Retention and modification of personal information
You can correct, update, or remove your personal information if it changes or if you no longer want to receive information from us beyond information related to our services. On the EverEx Rehab App you can correct, update, review, or delete information you have submitted by going back to the specific tool and making the desired changes. If you are unable to make the changes on the EverEx Rehab App, you can request EverEx Rehab to change, correct, or delete information by contacting us at support@everex.ai. We may not be able to completely remove your personal information from our systems in certain circumstances. For example, we may retain your personal information for legitimate business purposes, if it may be necessary to prevent fraud or future abuse, if required by law, or as retained in our data backup systems or cached or archived pages. All your personal information that we keep will continue to be subject to the terms of this Privacy Policy to which you have previously agreed.
We keep personal information until it is deleted, or until we no longer need it to provide you with the Service. EverEx Rehab stores and retains personal information based on the level of sensitivity of this information, and for the period specified by the applicable legal and regulatory requirements. For some healthcare data, your individual provider and/or their organization may require EverEx Rehab to retain data based on their individual legal and contractual requirements.
We will not retain personal information for any longer than is necessary to provide the Service for which we receive or collect the personal information, or for legal obligations.
You have the right to withdraw consent to EverEx Rehab’s use or processing of your Personal Information at any time. If you refuse to consent to, opt out of, or withdraw your consent, we may not be able to offer you certain services or benefits.
7. Access to information
You may have a right to request access to your information collected or processed by EverEx Rehab. You can request such access by contacting us at support@everex.ai. Upon verification of Your identity, we will make sure to provide you with a copy of the data we process about you. In some circumstances we may need to work with your healthcare provider in order to provide copies of sensitive information.
8. Children’s Privacy Rights
EverEx Rehab does not collect any information from anyone under 18 years of age. Our Services are directed at people who are older than 18 years.

9. International users’ privacy rights
If you are accessing the EverEx Rehab App and associated services from outside the United States, please be aware that you are sending information (including Personal Data) to the United States where our servers are located.

10. Changes to our privacy policy
EverEx Rehab reserves the right to make changes to this privacy policy at any time by giving notice to its users on this page. If you object to any of the changes to the Policy, you must cease using the EverEx Rehab App and can request that EverEx Rehab remove your personal information. Unless stated otherwise, the then-current privacy policy applies to all Personal Information EverEx Rehab has about its users.
